These terms are a contract between you and us. By registering or placing an order you accept them, together with our Privacy Notice, Cookie Policy, Payment Terms, Delivery Policy and Returns Policy, which all form part of these terms.
2. Definitions
- "Goods" — furniture and other items sold on this site, in three categories: in-stock, made-to-order, and clearance
- "Made-to-order" — goods manufactured to options you specify, such as size, material or colour
- "Order" — the offer to buy that you confirm through the system, which becomes a contract of sale once we receive payment and confirm it
- "Account" — the account you create to use the service
3. Who may use the service
- You must be 20 or older, or have the consent of the person with parental authority if you are younger
- You must give accurate, current information, particularly your name, telephone number and delivery address, which we use to contact you and deliver your goods
- You must keep your password and sign-in method confidential. Tell us at once if someone else has accessed your account.
4. Prices and ordering
- Prices shown on the site include 7 percent Thai VAT, in Thai Baht.
- The price of a made-to-order item depends on the options you choose; the system calculates and shows the final price before you confirm.
- Before you confirm, the system shows what you will pay, itemised line by line.
- We may refuse or cancel an order where the price was obviously wrong because of a system or typing error, where the item is out of stock, or where we reasonably suspect fraud. We will tell you promptly and refund you in full within 15 days if you have already paid.
- Payment terms, the stock reservation period and automatic cancellation are set out in the Payment Terms.
- Coupons and referral codes apply under the conditions the system shows on the order summary. A referral code can be used once per account, cannot be combined with a price-discount coupon (it may be combined with a free-delivery or delivery-discount coupon where the system allows), and we may cancel any discount obtained by abuse, such as creating multiple accounts to reuse a code.
- Terms stated on an individual product page — such as production time, warranty period, after-sales cover, or return restrictions — form part of the contract for that product. We always show them before you confirm your order. Where a product page term conflicts with these Terms, the product page term applies for that product, unless it would give you less than Thai consumer protection law requires.
5. Delivery, returns and liability for defects
- Delivery is governed by the Delivery Policy.
- Your right to cancel within 7 days under the Direct Sales and Direct Marketing Act B.E. 2545 (2002), returns, and defect claims are governed by the Returns Policy.
- We are liable for defects in the goods under the Civil and Commercial Code.
- Risk in the goods passes to you when you or someone you authorise takes delivery. Until then the risk is ours.
6. The nature of handmade work
Our goods are handmade from natural materials. Wood grain, leather grain, colour and texture therefore vary slightly from piece to piece, and photographs may show colours differently because of lighting and screen calibration.
Which characteristics are normal for handmade work, and which count as defects, is set out in Returns Policy section 3.3.
7. Intellectual property
- All content, images, product photography, logos, trade names and designs on this site belong to us or to our licensors, and are protected by the Copyright Act B.E. 2537 (1994) and the Trademark Act B.E. 2534 (1991).
- You may not reproduce, adapt, publish or commercially exploit them without our written permission.
- You may of course view and use the content normally to browse and decide what to buy.
8. What you must not do
You must not use this site to:
- Access another person's account or data without permission, or attempt to circumvent security measures
- Run automated programs to scrape data, generate bulk orders, or place abnormal load on the system
- Abuse coupons or benefits, for example by creating multiple accounts to claim the same offer repeatedly
- Send unlawful, defamatory or infringing content through any channel on the site
We may suspend or close an account that breaches these rules, and we will tell you why; you may dispute our decision with us. Suspension does not affect your rights in orders you have already paid for — we still owe you the goods or a refund as agreed.
9. Our liability
- We are responsible for loss caused by our failure to perform the contract or to comply with the law, to the extent the law provides.
- We do not limit or exclude our liability for wilful misconduct or gross negligence, for death or personal injury, or for defects in the goods, as Thai law requires.
- For other loss that the law allows us to limit, our liability is limited to the amount you paid for the order concerned.
- We are not liable for events reasonably beyond our control, such as natural disasters or government orders, but we will tell you promptly and offer you the choice of waiting or cancelling with a full refund.
10. Personal data
We collect and use your personal data in accordance with our Privacy Notice, issued under the Personal Data Protection Act B.E. 2562 (2019).
11. Changes to these terms
We may amend these terms and will show the effective date at the top. If a change materially affects your rights, we will tell you in advance by email or by a notice on the site.
Amendments do not apply retrospectively to orders you have already confirmed. Your order is governed by the terms in force when you confirmed it.
12. Complaints and dispute resolution
- Please contact us first at bummiras@gmail.com or +66 85 120 2053. We will reply within 7 business days.
- If you are not treated fairly, you may complain to the Office of the Consumer Protection Board (OCPB) on 1166 or at https://www.ocpb.go.th
- For disputes under the Direct Sales and Direct Marketing Act B.E. 2545 (2002), you may complain to the OCPB's Direct Sales and Direct Marketing Consumer Protection Division.
13. Governing law and jurisdiction
These terms are governed by Thai law, and disputes are subject to the jurisdiction of the Thai courts.
Nothing in these terms removes or limits any right Thai consumer protection law gives you. If any provision conflicts with the law, or is an unfair contract term under the Unfair Contract Terms Act B.E. 2540 (1997), that provision has no effect to the extent of the conflict, and the rest of these terms continue to apply.
